Calldera Privacy Notice

Calldera, LLC ("Calldera," "we" or "us") provides personalized wine recommendation subscription based services utilizing its proprietary Calldera application and related offerings and features (the "Services") through its website and mobile apps (collectively, the "Site"). This Privacy Notice describes how we collect, use, and share information that applies to our Services, and your choices about the collection and use of your information.

By accessing our Site or subscribing to our Services, you acknowledge that you have read, understood and agree to our collection, storage, use and disclosure of your information as described in this Privacy Notice.

Information Covered by This Privacy Notice

This Privacy Notice applies to information, including Personal Information, collected about you by Calldera and its third-party service providers. As used herein, "Personal Information" means information that identifies you or would enable someone to contact you. This Privacy Notice does not apply to any third parties or any sites that might be linked to our Site or Services, including, without limitation, any wine merchants.

Information Collected

Calldera and its third party service providers collect information about you from a variety of sources, including information you provide directly to us when you subscribe to our Services, and information we collect about you when you visit the Site, utilize our Services, and otherwise interact with us.

Information You Provide Us. If you subscribe to our Services or correspond with us, you will be asked to provide certain Personal Information such as name, address, email, phone number, date of birth, and credit card information. If you provide Personal Information to us, you are telling us that this information is both true and accurate, and that you are authorized to provide it to us. We may also retain any messages you send through the Service, and may collect information you post in connection with your subscription and/or the Services (e.g., wine recommendations). We use this information to operate, maintain, and provide to you the features and functionality of our Services and the Site.

Information Collected Automatically

Analytics Information: We may directly collect analytics data, or use third-party analytics tools such as Google Analytics, to help us measure traffic and usage trends for the Site and Services. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Site and Services. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

Cookies: When you visit the Site, we may send one or more cookies, a small text file containing a string of alphanumeric characters, to your computer that uniquely identifies your browser and lets us help you log in faster and enhance your navigation through the Site. A cookie may also convey information to us about how you use the Site and Services (e.g., the pages you view, the links you click and other actions you take on the Service), and allow us or our business partners to track your usage of the Site and Services over time. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by following your web browser's directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site and/or Services may not function properly if the ability to accept cookies is disabled.

Log File Information: Log file information is automatically reported by your browser or mobile device each time you access the Site. When you use our Site, servers may automatically record certain log file information. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, and other such information.

Clear Gifs/Web Beacons: When you use the Site, we may employ clear gifs (also known as web beacons) which are used to anonymously track the online usage patterns of our users. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information facilitates more accurate reporting and improvement of the Site and our Services.

Location Data: When you access the Site or Services via a mobile device, we may access, collect, monitor and/or remotely store information regarding your mobile device as well as real-time "location data," which may include GPS coordinates (e.g. latitude and/or longitude). Location data may convey to us information about how you browse and use the Services. You may opt-out from allowing us to have access to your location data by adjusting the permissions in your mobile device, though some features of our Services may not function properly if use or availability of location data is impaired or disabled.

Information We May Receive From Third Parties. We may receive information about you from third parties. For example, if you access our Site or Services through a third-party connection or log-in (e.g., through Facebook), such third party may pass certain information about your use of its service to us. We may also receive information from our business affiliates and other users.

Information Use

We use your information that we collect, including Personal Information, for a variety of business purposes, including:

  • processing subscription payments;
  • communicating with you regarding our Site and Services;
  • tailoring our Site, Services, and communications to your interests;
  • creating and managing your subscription accounts;

  • for internal operations such as enhancing our subscription offerings, marketing efforts, and to conduct research and analysis;
  • developing new Service offerings and features;

Additionally, we may use information collected automatically from you to:

  • remember information so that you will not have to re-enter it;
  • provide custom, personalized content and information;
  • provide and monitor the effectiveness of our Services;
  • monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns;
  • diagnose or fix technology problems;
  • help you efficiently access your information after you sign in; and/or
  • automatically update the Calldera application on your mobile devices.

We treat information collected automatically from you as non-personally identifying information.

We may combine any of the information collected about you for the purposes described in this Privacy Notice. To the extent that information collected automatically is combined with Personal Information, we treat the combined information as Personal Information for the purposes of this Privacy Notice.

User Recommendations/Posts

Our Services allow you to share wine recommendations and other information with friends and post information to social media sites such as Facebook and Twitter. Information that you share can be collected and used by others. You are responsible for all actions resulting from any information, including Personal Information, which you share via our Services or social media platforms. Please remember that any information you share or otherwise post becomes public information, is not subject to this Privacy Notice, and Calldera is not responsible for the results of such postings.

Information Sharing and Disclosure

We share and disclose your Personal Information under the following circumstances:

  • with third parties that provide a variety of services on our behalf, including the development, maintenance, and support of our Sites and Services, payment processing, the distribution of email and mobile messages, and marketing research and analysis;
  • with business affiliates in connection with our Services and for marketing purposes;
  • to comply with law, a court order, or other legal process, or in connection with a legal investigation;
  • as may be necessary to protect the rights and interests of Calldera, its business affiliates, and suppliers, and our and their respective employees, customers, visitors, users, or any other person or entity;
  • to enforce any applicable terms and conditions and other agreements;
  • in the event of a corporate transaction, such as a merger or acquisition;
  • in aggregated or other non-personally identifiable form; and/or
  • in accordance with your consent.

We may share your information with third-party business partners for the purpose of providing the Services to you. We do not, however, sell your Personal Information to third parties for their marketing purposes.

Your Choices About Your Information

You can confirm, change, delete or update Personal Information you have provided to us by logging into your account and changing your information. If you have any questions about reviewing or modifying your account information, you can contact us via the Contact Information provided below.

If you wish, you can also opt-out of receiving promotional emails from us by clicking on the "unsubscribe link" provided in such communications or contacting us via the Contact Information section. When you opt-out of promotional communications from us, you will receive service messages. We make every effort to promptly process all unsubscribe requests. You will, however, continue to receive Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices, etc.).

You may be able to opt out of the collection of some information that is collected automatically by referring to your web browser's or mobile device's options or settings menu. However, doing so may disable many of the features available through the Services.

Following termination or deactivation of your subscriber account, Calldera may retain your Personal Information for backup, archival, or audit purposes.

Google Analytics

Our Site uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics collects information such as how often you visit the Site, what pages you visit within the Site, and what other sites you visited prior to coming to the Site. We use the information provided by Google Analytics to improve our Site and Services. For more information regarding how Google collects, uses and shares your information please visit http://www.google.com/policies/privacy/partners/. Google provides users more choice on how their data is collected by Google Analytics by developing an Opt-out Browser Add-on which can be located at: http://tools.google.com/dlpage/gaoptout?hl=en. By installing this Add-on, no information is being sent to Google.​​​​​​​

California's Do Not Track Notice

At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, our Sites are unable to respond to Do Not Track Signals.

Calldera does not allow third parties to collect Personal Information about your online activities when you use our Sites for such third party use. We do use third party web analytics services on our Sites, such as Google Analytics, to help us obtain and analyze information about your browsing or usage habits but this information does not include Personal Information other than your IP address.

E-mail Security

"Phishing" is a scam designed to steal your Personal Information. If you receive an e-mail that looks like it is from us asking you for your Personal Information which you suspect may be a scam, please notify us as provided in the Contact Information section included at the end of this Privacy Notice.​​​​​​​

Users From Outside of the United States

This Site and our Services are provided from within the United States and are subject to the applicable state and federal laws of the United States. If you use the Site and/or our Services, you consent to the use and disclosure of your information in accordance with this Privacy Notice and subject to such laws. Children's Privacy

Calldera does not knowingly collect or solicit any information from anyone under the age of 21 or knowingly allow such persons to register as subscribers. In the event that we learn that we have collected Personal Information from a child under age 13 without verification of parental consent, we will work to delete it. Information Security

We seek to keep your Personal Information secure and implement reasonable technical, administrative, and physical safeguards to help us protect such information from unauthorized access, use, and disclosure. When we collect or transmit sensitive information such as a credit card number, we use industry standard methods to protect that information. We also request that our third-party service providers use commercially reasonable security measures to protect your information from unauthorized access or use. However, no method of electronically transmitting or storing data is ever completely secure, and therefore, we cannot guarantee that your information will never be accessed, used, or disclosed in a manner that is inconsistent with this Privacy Notice.

In the event that any Personal Information under our control is compromised as a result of a breach of security, Calldera will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Links, Third-Party Websites, and Social Media Platforms

Our Site, Services, and communications may contain links to other websites and social media platforms such as Facebook or Twitter ("Linked Sites"). We are not responsible for the privacy practices, policies, or content of any Linked Sites, even if you link to them from our Site or Services. This Privacy Notice does not apply to any Linked Sites. We have no control over the collection or use of information, including Personal Information, on any Linked Site. We encourage you to read and understand the privacy practices of any Linked Sites that you visit.​​​​​​​

We may update this Privacy Notice from time to time effective upon posting the revised Privacy Notice, along with the date on which it was most recently updated, on our Site.
